RETURN POLICY
You have the right to terminate the Contract for the purchase of items (hereinafter the "Contract") concluded with the "MY BRANDS" MMC company (hereinafter the "Seller", "we") and return the purchased items without any penalties within fourteen (14) days from the date of receipt of the items purchased on “mybrands.az”, unless the applicable law provides for a longer period of time.
Method of termination of the Contract: properly fill out and send to the Seller the electronic return form available in the Customer service section on “mybrands.az”.
Once it is confirmed that you can use your right to terminate the Contract, the returned goods must be delivered by courier, in accordance with the rules set in the following sections, within fourteen (14) days from the date of receipt of the goods, unless the applicable law provides for a longer period of time.
You do not have the right to terminate the Contract in cases established by applicable law, for example, if you purchased personalized or custom-made products and/or products in sealed packaging that were opened after delivery and cannot be returned in accordance with hygiene regulations.
1. Terms of use of the right to terminate the Contract
The right to terminate the Contract is considered to be properly used if the following conditions are fully met:
a. the right to terminate the Contract has been duly exercised within fourteen (14) days from the date of receipt of the items purchased on the “mybrands.az”, unless the applicable law provides for a longer period of time.
b. the items have not been used, worn or washed;
c. the items still have an identification tag (it is an integral part of the product);
d. the items are returned in their original packaging.
e. the items are delivered to the courier service within fourteen (14) days from the date of their receipt, unless the applicable law provides for a longer period.
f. the items are not damaged.
If all the necessary conditions are met, the Seller fully refunds the Buyer the cost of the purchased items, in accordance with applicable law. The only expenses incurred by you are the costs of shipping of the items to the Seller.
*Perfumery and cosmetic products are non-returnable
2. The return procedure of the items to the Seller
You can return the purchased items to the Seller via the courier service of your choice, and the payment for delivery of the returned product is covered by the Buyer.
3. Verification of the compliance of the returned items with the established requirements
If the returned products cannot be accepted by the Seller due to their non-compliance with the above requirements, you will receive appropriate notification. If the items returned by you do not meet the requirements set in subsections 1 (a), (b), (c), (d), (e), (f), you are not entitled to the refund of the amount paid by you when purchasing the item. If your return is not accepted, the Seller will notify you by an email. Within fourteen (14) days from the date of receipt of this email, you may request the item to be returned to you at your expense in the same condition that it was when you returned it to the Seller; you must notify the Seller in accordance with the terms and conditions that will be communicated to you. Otherwise, if you do not submit the Seller a request for the item to be returned to you in the same condition that it was when you returned it to the Seller, and will not pay in advance the shipping costs or will pick up the item, such inaction will constitute your waiver of the right of ownership of the item and give the Seller the right to dispose it at own discretion.
The seller is not responsible for any products damaged during their transportation to the warehouse, or for items left inside the returned products or their packaging.
4. Refund terms and procedures
Once the Seller has received the returned items and verified that they meet all the requirements, you will be sent an email confirming acceptance of the items and full refund of the payment by the Seller. The refund process will be launched after verification of compliance with the above-mentioned return conditions.
The refund is made by the Seller using the same payment method that you used when purchasing the returned items, unless you have clearly agreed with the Seller to use a different payment method, provided that you will not incur any additional costs as a result of the refund. If the recipient of the goods included in the Order and the person who made the payment for these goods are two different persons, and the right to terminate the contract is implemented, the refund will be made to the person who paid for the Order.
Credit / debit card: the refund period may vary depending on the Bank issuing the card.
5. Return of the damaged or defective products and the products that do not match the order
In case if you return the item due to a mistake made by the Seller or because it is damaged or defective, you must notify the Seller via the electronic return form within fourteen (14) days from the date of delivery.
You must return the damaged, defective items, or the items that do not match your Order in the same condition that you received it. The clauses a), b), c), d), e) and f) of section 1, that formulate the main terms for the return of items and the provisions of section 2 apply for the same.
The seller checks all items that are returned as damaged, defective or not matching the Order in accordance with the procedures set in section 3. Once the Seller has determined that the items returned by you as damaged, defective or not matching the Order are indeed such, the full cost of the items will be refunded to you, including shipping costs (in accordance with the procedure set in section 4) and the Seller will send you an email with due notice within a reasonable time.
If the seller cannot be held responsible for damages or defects in the returned items, you will be informed that your return is not accepted; in this case, you may request the item to be returned to you at your expense in the same condition that it was when you returned it to the Seller; you must notify the Seller in accordance with the terms and conditions that will be communicated to you. Otherwise, if you do not submit the Seller a request for the item to be returned to you in the same condition that it was when you returned it to the Seller, and will not pay in advance the shipping costs or will pick up the item, such inaction will constitute your waiver of the right of ownership of the item and give the Seller the right to dispose it at own discretion.
6. Identification tag
We remind you that all products offered by the Seller are equipped with an identification tag, this tag is an integral part of the items. We request you to try the products on without removing the tag. The items returned without a tag will not be accepted by the Seller.
7. Applicable law
The “Return Policy” is an integral part of the “General terms and conditions of sale” and is governed by the applicable legislation of the Republic of Azerbaijan on consumer protection.
